Anmerkung | "The formula ‘by title of new donation’ was included in Hungarian royal charters from the fourteenth century onwards. To begin with, the formula was inserted with a view to remedying defective deeds or making good claims to ownership which lacked proper documentary support. The title of new donation was also included, however, in charters of donation relating to properties to which the crown or petitioners might subsequently lay claim by reference to latent royal rights. In this respect, the purpose of the formula was to set aside the royal right and so establish an existing owner more firmly in legal possession of his estate. The author builds his argument on study of the extant charters, later medieval formularies, Werbőczy's Tripartitum, and the works of later Hungarian jurists. He disputes, in particular, Pál Engel's recent assertion that the principal function of the title of new donation was to alter the terms under which estates were inherited through the closer specification of heirs." |
